Misrepresentaion of Contract

Dear MTN

I have been a long time supporter of MTN and its services, and stand a strong advocate of the service provider. But I feel that I have been duped into a contract that has my bill sky rocketing.

I entered into an Unlimited (fair use) DATA-ONLY contract with MTN around July 2012, which is a R269pm x 24 months, with the number 078 422 9605. I had asked the sales rep at Sandton City MTN if any extra charges would come with the contract, and he said NO, that I would only pay the fixed R269 per month irrepective or my usage for data or calls.

To my surprise my bill is now well over R3000, and I have credit that I have never agreed to. When I called Customer Care about my query, i was dealt with a very rude consultant that did not assist me at all.

With consultation with my lawyer for advise, this billing falls under Misrepresentation of Contract and Consumer Protection ACT violations, as I did not enter into a open line contract and never have.

I feel cheated and duped, and would like MTN to refund me on all the months of incorrect billing adjusted to the R269pm that I have signed into. If my billing is not correct I will have to get my lawyers involved and the media.
