Cell c does not seem to comply with the CPA!

I was constantly experiencing trouble with my handset. During the month of November, i booked the phone in and requested a new handset as it was still within the first 6 months, but i was refused that. During December i received the handset, only to find out that it had been dented and the back cover wasn't closing. I then booked the handset in and received it at the end of December. After using the phone for a week, i noticed the phone had just been worse. I had booked the phone in again! In terms of the CPA, within the first 6 months if the cellphone malfunctions in some way and not because of something you've done to cause the problem, you can choose your remedy - repair, replacement or refund. The store has the right to send the phone away for assessment to rule out user abuse, but may not take it upon themselves to repair it during this 'assessment' period if you have asked for a refund or replacement. If you opt for a repair, and the phone fails again with three months - for any reason, it doesn't have to be the same fault - the supplier may not repair it again. In terms of the CPA the only remedy after a failed repair is a refund or replacement, so i expect a new handset
