3-4 week to repair brand new phone!

I recenetly renewed my Nashua mobile contract. I have been a Nashua Mobile client for 4 years.
As part of the contract renewal I received a new handset, but within the first week I noticed the device will shutting down randomly and only after removing the battery 10 times, will it reboot again. These events persistet, until 8 days ago when I took the handset back, where it was send for repairs. I followed up today, only to be notified that repairs could take 3-4 weeks, which is rediculous, bearing in mind that the device is hardly 5 weeks old.

Secondly the branch could not supply me with a loan handset as they have none available, again I find this unacceptable, as I am paying for a phone, brand new, which is in for repairs and even worse is the fact that Nashua could not even help me out with a loan device. In terms of the Conumer Protection Act 68 of 2008, If goods bought by consumers fail in some way, the consumers get to decide which of the three Rs - a refund, replacement or repair. The handset in question was brand new, so I would rather have opted for a replacement, than a repair that takes 3-4 weeks!
