3rd S3 Galaxy also faulty on Vodacom contract

On 23 Feb 2013 I upgraded my Vodacom contract through CelluCity to a Smart Advance package.
Within 7 days the 2nd new Samsung S3 Galaxy handset was found faulty... software froze, excessive amount of dropped calls and often very bad call quality.
I contacted Dale at Head Office JHB and he arranged for a new S3 handset... the 3rd one.
Within a month after receiving the 3rd S3 Galaxy I complained with Dale that I am having the same issues as before although not as frequent. In fact, during our conversations the calls dropped several times even though I called him on his office nr which is a fixed line.
On 17 Sept 2013 I mailed Andre at Customer Care since the data dongle's signal also started with issues and the phone became progressively worse, dropping calls every day by then. As a result 3 Vodacom technicians visited, & each identified various problems. None of the suggestions have been executed yet.
What concerns me is none suggested the S3 handset could be faulty.
By Oct I no longer received an sms on time. So I had to borrow a Note2. All problems solved.
Now Vodacom refuses to replace the THIRD dud Samsung S3 they issued.
Would litigation & refusal to pay solve this mess???
