Phone under warranty not repaired / replaced

I did the usual iPhone upgrade (as I did on my iPad, as did my family and friends who all have iPhones) on 30 September 2013. All took the upgrade well, except my iPhone. Took the iPhone to Vodacom shop who sent me to Customer/Repairs where various people tried to fix it, then said I had to hand it in. I got the phone back on 11 October and was told to go to the shop and claim on insurance, which I did. Insurance phoned me and said I couldn't claim as it should be claimed on warranty. I spoke to 13 people in total from Vodacom Insurance, Customer Care, the Shop, and Repairs. Insurance tried to help but can't as it isn't their claim. Customer Care just do not know their business and can only repeat what they have been told, even the manager on duty fobbed me off. Repairs told me to bring my phone in again for assessment, even though the report says it needs to be replaced! The shop manager told me as I had done the software upgrade, it was customer negligence and therefore I cannot lodge a claim!! I, and everyone I know, does a software upgrade - I've done it for years, ever since iPhones came to South Africa.

I pay approximately R4000 each month to Vodacom and this is what I get
