Claim paid to wrong person against a quotation

In December 2011 the son of a neighbour drove into and damaged my front gate. My house is occupied by a Tenant. I was requested to supply a letter from my own insurance, Virgin, stating that I would not claim in this matter as the insurance company of the party who caused the damage would make payment. I was advised in March 2013 by the mother of the boy who caused the damage that her insurance company, Budget, had paid out the claim but the gate had not been replaced. I spoke to Earl from the Legal Dept at Budget Insurance and confirmed to him that he had paid the money to my Tenant, and on asking for a copy of the invoice against which payment was made, Earl advised that the claim was paid against a quote. All of this is extremely irregular. I have been in contact with Earl at least 8 times since March asking that he recover the money incorrectly paid out to my Tenant, but up until this time he has not done so and the damaged gate is still in place at my house. The Tenant has simply banked the money and Budget appear unwilling to do anything to recover the money so that I can effect the necessary replacement of the gate.
