A friend and I stayed over at Whale Cottage over New Years.
We arrived and decided to sit in the public pool area and relax. I made use of one of the pool loungers which tore as I sat on it. Not having signed any document saying I will be liable for damages to public area property and having used the facilities in an orderly manner, I did not think much of this as the loungers were not new and clearly exposed the the sun everyday. Also my assumption of an establishment is that they should look after their public area facilities and that this should be insured accordingly. We left the following day after sitting out by the pool area for a while. On my return I saw that an additional R750 was deducted of my credit card. I contacted whale cottage to advise they made a mistake and was told it is the replacement of the pool lounger. I requested the document I signed that will hold me responsible - still awaiting. Also asked how they can do this without permission and how they can prove that this had no previous damage to it. I would also like to know when this lounger was originally purchased as I cannot be held responsible for a new lounger or lack of insurance. Find this shocking.
