Unrepairable new device replaced by a second hand

I am told by Gugu of the call centre that my phone is unrepairable and its replaced by an old phone. I wasnt happy even when it was with them but decided to let it down. All I need is a fair service for any unreiparable phone or any good you get a new from where is this second hand phone is coming from I dont want to be responsible for some old phone that is going to give me more grief. I have had this phone for 3 months only and the fault wasnt caused by any negligence from my side I think its purely a factory fault.
