Iburst
Charging beyond contract term

Telecommunications

My iBurst contract term ends on 8 November 2013. Following iBurst's standard terms and conditions, I gave the required notice to terminate my contract at the end of the term as I no longer required the services of iBurst, to which they gave me a reference number. I then got a response from Veliswa that my contract will only be terminated on 30/11/2013. I queried why this was the case as I was not contractually obligated to pay any fees beyond the end of my contract term on 8 Nov 2013. I then got a reply from Dudu saying that this is "stipulated in the terms and conditions and they cannot overwrite it". I read iBurst's standard terms and conditions, and Part 1 Section 2 (Commencement, renewal and termination) says NOTHING concerning this. Additionally, Section 14 of the Consumer Protection Act does not allow a service provider to charge any fees beyond the fixed term contract term of 24 months, unless agreed upon within the service provider's terms and conditions which do NOT state this. I am considering taking this up with their regulatory body as a matter of principle.
