Default on warranty

I have been without my 9300 Blackberry for over 10 months now, not withstanding the fact that I have to continue paying my 24 month contract. My phone was handed in for repairs due to a faulty track pad.
The phione went to and fro and they have declined to repair it under warranty as they blame the slight scratches on the lens for the problem. This is hog wash, as the defect started long before the scratchs.
Mtn further deny that Blackberry has issues with a lot of their track pads, which is totally untrue. My 9320 at 3months developed the same problem. Is it possible that we are being done in and their is no recourse?
