No warranty on black berry

In January 2012 i lost my blackberry 9300 and it was insured with Vodacom and they replaced it with a new 9300. the phone worked fine for about 32 days and then the scroller would go scroll up uncontrollably i took it back and was told i would receive a refurbished phone. i refused and just kept the phone as i paid for a new phone and did not want a second hand refurbished phone. And as i had just started in a new company and needed the emails i couldn't do without the phone for 14 working days. So on the 22 January 2013 the scroller stopped working all together and i took it in for the repair. Only to be told that it's not covered under warranty and will cost me more to fix than to get a new phone. so i rejected the quote and as soon as my contract is over i am going to change service providers, as i am 6 months away from upgrade and don't have a working cell phone to receive any emails of have contact with any of the contacts on the bbm which i use for running my company. i don't know if it's all Vodacom to blame or blackberry but i would expect the company that I'm paying every month to at least help enforce my warranty
