Want to give me a refurbiched phone

My blackberry 9300 is not working properly any more and sent it in for repairs.now they tell me if they can't fix it I wil receive a refurbished phone. I don't think that is write.my fiance had the same problem with his by cell c and the replaced the phone with a new blackberry 9320 not even a 9300 again.so why could he get a 9320 and mtn won't give me a new phone.
