Vodacom not honouring contract

We signed a 2 year contract with Vodacom (V) in April 12 where we got a free BB 9360 phone. The V warranty is for the contract duration. The battery failed and V tries to pass the responsibility to BB, as BB warranty for the battery is for 1 tear only (this will apply if we buy phone from them directly). We signed the contract with V, signed nothing with BB. RSA law requires the vendor (V) to clarify contractual exclusions and get signed agreement. This was not done, therefore the full 2 year warranty applies to the phone and all its components. When BB service went off line, V avoided responsibility and did not credited clients for the time without service. V cannot accept responsibility only when it suits them. I cannot be without a phone and therefore I am buying a new battery and expect V to fully refund the cost. The contract is clear: it covers the unit for 2 years and we expect the contract to be honoured and will proceed to the Ombudsman if this does not happen.
