Is a "no refund policy" legal?

On 21/12/12my son purchased an Adidas Hooded Jersey from Cross Trainer Cresta as a Christmas gift for his sister. The item did not fit so on 28/12/12 we went to Cross Trainer Clearwater Mall, Strubensvalley, to inquire about a bigger size. They did not have stock but checked on their computer system and found one at Cross Trainer Eastgate. It was arranged that the item wouldl be delivered to the Clearwater branch within 2 - 3 days. Cross Trainer Clearwater agreed to call us when the item arrived. On 7/1/13 my son called since he had not heard from them. He was told "sorry Eastgate made a mistake they do not have the item". He asked why the store had not called to give him this feedback and the response was "sorry". Today, 10/1/13, I took the item to Cross Trainer Cresta, the store it was purchased at, and requested a refund since there was nothing in the store that my daughter wanted to exchange it for. I was told by Norma Musa the store manager that the company policy was no refunds only exchanges or a gift card. The item was in the original package, with the label still attached and I had the original receipt. She called the Reg. Mngr and he refused to grant a refund. Legal?
