Not paying Deposit back

Hi I rented I 4bedroom house from Allen real estate in Vredenburg. When I got the house its was dirty and full of spiders and the yard was also not tide and very long grass. The walls needed a paint job and cracks in the floor. The carpets had stains on them. They said they have cleaned up but they didn't the owner came a month later to clean up the yard and send somebody to wash the carpert. I signed a 1year contract but inform Jo-ann from day one I am not happy with the house she said she will sort it out and never did. I gave them a month notice period and and she said on contract it state I must pay R2300 from contract brake. I told her its fine and she must take it off of my dep. Jo-ann said she will pay my dep on the end of jan 2013.When I phoned her 31jan she said they are keeping my full dep of R5500 until they get new tennants for house. I payed I whole month and only stayed 2week when I moved out... so they have 2weeks rent bonus plus the contract braking of R2300. And she also has my key dep.
