Making excuses to pay out claim for damaged pool

Our swimming pool was damaged on account of heavy rains during March 2011. The pool lifted out of the ground and the paving collapsed underneath the pool. I logged a claim with Nedbank's Insurance Division. An Assessor was sent to our property. Nothing was heard from Nedbank after that. I phoned them after a few weeks and was informed that the claim was declined on account of the water level. I phoned Jennifer Saayman from Nedbank Insurance Division and sent her pictures of the damage. A second assessor, Ron Pearse came to assess the damage. He requested a quote form Penguin Pools which I obtained and e-mailed to him. Again we heard nothing from Nedbank. Our lawyer phoned Jennifer Saayman and she telephonically made an offer of 80 % of the damage incurred. Mr Steven Raseobi from Nedbank now denies that such an offer was made. We received a pathetic settlement offer from Mr Raseobi, which we declined. We now received a letter from their lawyer where thay state that fibre glass falls under the definition of plastic and vinil and that we are not covered. The Fibre Glass was never an issue. We received a second offer which is still unacceptable. We did not cause the damage
