Client liable when insurer refuses to pay

On the 6th October 2013, in Huguenot St. Franschoek. The motorcycle next to mine toppled over and struck my motorcycle knocking it off its side stand, falling over onto its right side causing considerable damage to the body work. Quote to repair R49, 000
I informed the owner that I held him responsible for the damage caused and stated that I intended to claim against him. He agreed to this and was co-operative and provided me with his insurance details and a claim number and I lodged my claim with M&F. M&F rejected my claim as the owner of the vehicle stated that his motorcycle was blown over by a gust of wind, this is considered an act of and not covered. I then submitted photographs taken at the scene to show that their client's motorcycle was not parked correctly as well as wind speed statistics from the University of Stellenbosch showing that the wind on that day and time was average. M&F continued to reject the claim and have now become totally uncooperative. An act of is an extreme weather event for example a tornado and in this case it certainly was not.
I will be suing the owner of the other vehicle. Well done to M&F for saving R49, 000 in damages.
