Claim still not settled after almost 5 weeks

My motorbike was damaged by a illegal speed hump that was placed on a road leading to our Waterfront so my motorbike got damaged on the 16th June. I lodged a claim against my Insurance and the next week the Assessor came to see my bike. He gave me the go ahead to order some of the spares as he was going to recommend that the cash be paid out to me so that I can have it repaired. Once completed he would have collected all the damaged spares.By doing it this way, I can keep the cost as low as possible as their is no labour cost etc.

I have now been notified that they can't pay me out as i don't think they can trust themselves so it seems like they trust nobody. Well it is now exactly a month and nothing has happened yet. If the claims takes this long to finalize, how long is it going to take their Legal Department to recover the cost from the other person's Insurance? In the mean time, I have to pay the access, my premium goes up and I lose my no claim bonus. PATHETIC!!
