Still NO outcome!!

I have not had a phone since the 18th of February, I wrote on Hello Peter with this regard and received a response saying that someone would contact me, no one has, I was recently contacted by the store in question and told I have been given a new phone and so excited and pleased I went to collect the new phone only to find out it is "refurbished" and that apparently you cannot have your handset replaced if it is older than 6 months, WHY WAS THIS NOT TOLD TO ME EARLIER? Why was I informed that there was a NEW phone awaiting me. I am seriously considering taking this further, where is the consumer act when you need it?? I do not want to take a refurbished phone, in fact I would rather cancel my existing contract and I want my money back seeing as I am paying for a phone that I do not have. When will someone actually assist me? When will I get what I paid for and am STILL paying for?? I always loved vodacom, I have been with you forever, but this is ridiculous!!! Please do not respond with an automated response, please take the effort to LISTEN to your clients and actually provide a PROPER SERVICE AS PROMISED!!! Please!!!
