Returned iPhone 5 within 5days but it was refused

I bought a iPhone5 on contract on the 25 March '13. I started using the phone on the 26 March, since i was waiting for contact migration. No first use, I noticed that the audio is faulty. When I dial and receive calls i cannot hear or be heared. Over and above that the battery lifespan is so bad. I charged the phone over night and the next morning at 09:44 the battery will be dead. I returned the phone on the 28 March and was told that it will be send for repairs since iPhone5 doesnt have a 7days return policy and i should bring it after the holidays. I took the phone in today 03/04/2013 and i was still told th same. I cannot be without the phone for 3 weeks! and what make this worse if the fact that the sim car (macro) used on iPhones cant be used elsewhere. I callled the 8ta contact centre and the consultant was alarmed by this new iPhone procedure which they were not aware of. Edgar Rampfumedzi contacted the sale lady who gave me the contract and he was told the same, despite the fact that the tems and condition that are in my contract says that there is a 7days return policy. Why did i be given a iPhone contract where the terms and condition will state that there is no 7days?
