No insurance cover on upgrade

My first cellphone contract included insurance so when i upgraded i automatically assumed i would be covered.by cell c insurance for my upgrade. My cellphone (blackberry 9900 bold) was then in a incident where a came into my flat while i was sleeping and my laptop and cell phone (not called a breakin, as the came through a weindow- though i liuve on the 3rd floor!)

i reported the and contacted cell c, and this was when i found out i was not covered. i was then told to submit a letter subject to approval of insurance (in regarding to circumstances) and this application was rejected 3 times.

how does cell c justify refusing my claim where their callcentre agent made no attempt to enquire to if i would like insurance - but on having my details of my previous contract knew i had insurance cover, secondly considering the value of the phone - i as a person who deals with customers on a daily basis would definitely have recommended insurance (to safeguard the customer and reflect the type of service the company provides and thirdly, i have read the contract booklet and no mentyion is made that a customer has to initiate trhe request for insurance..
