Cellphone Upgrade Gone Wrong

Sat, 16 Feb 2013, upgraded 1 of our cell contracts at Vodacom Hemmingways in EL. When we signed the upgrade form, the sales person indicated that shld the phone give us any problems within the 1st 7 days they will replace the phone with a new phone "sealed in a box". Arrived home, charged the phone for the required 8 hrs first charge. After charging started using the phone and the phone froze. Backlight remains lit until the battery drained. Went to Vodacom Hemmingways on 18, 21, 22 Feb, 2 Mar 2013, indicated the phone was faulty and requested our new phone as was indicated on the day of our upgrade. We were advised that vodacom had small print they cannot just give us a new phone. The phone has been back and forth each time coming back saying there is nothing wrong with the phone. I have photographs and video evidence that the phone freezes and does not switch off until the battery has drained. Vodacom Hemmingways have indicated there is nothing else they can do for me and I must not come back to them. I have phoned the 082111 number and 0821959 customer care upgrade dept. with no joy. I am now stuck in a 2 yr contract with a faulty cellphone. WHAT NOW?
