Phone not charging after software update

I took out my third contract on the 31/10/2012. my sister is using the phone. the phone was booked for repairs on the 25th February as the phone was not switching on. The consultant, Thareef Rashid, informed my sister that the software needed to be updated. my sister received her phone last week and since then there has been a problem with charging the phone. The consultant informed my sister that they will have to book the phone in for repairs again and that there will be a charge, for that, that will be debited on my account. This is totally unacceptable as the phone was charging before it went in for repairs and was thus damaged when it was booked in for repairs. i refuse to pay for the repairs and want MTN to foot the bill as their service department has damaged the phone. i also have a report with me which states that the phone had no other defects when it was booked in.
