Cell C not complying to Consumer Protection Act

With regards to my previous complaint - Busi insists that the phone has to be booked in, sent away for approval and then replaced for me to get a new battery. According to the consumer act if I wish to return the phone within 7 days they must replace it. There is no such thing as it having to be sent away and a replacement approval. This is not acceptable.

In terms of s56 (read with s55) of the CPA, all goods sold to a consumer are sold with an implied warranty of quality, that cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that:
o are reasonably suitable for the purpose that they are intended to be used for,
o are of good quality, free of defects and in good working order, and
o will be durable and usable for a reasonable period of time.

If goods are found not to comply with these requirements then;
o up to 6 months after receiving the goods;
o the consumer can return the goods, or
o get the goods replaced, or
o get the goods repaired.
o The consumer can do any of these things without penalty; and
o at the suppliers cost.

My battery has a 6 month warranty. As stated above I can have the battery replaced and cell c must do this
