Good day,
I sent an email to Edgars on behalf of my sister. She bought a phone on 1/3/2013 at Edgars on account. She thought the phone can What's App. 4/3/2013 she took phone back as it does not support What's App. They refused to take phone back.
Part of the responce I received from Edgard today:
"If a consumer informs a supplier that the goods are being bought to fulfill a particular purpose, and the suppliers advises that the goods will meet this particular purpose then 10 days after receiving the goods the consumer can return the goods if not suitable for the particular purpose."
According to the Consumer Protection Act she is well within her rights to return this product."In terms of s16 of the Consumer Protect Act, if a consumer has bought goods are a result of direct marketing, then for a period of 5 days after receiving the goods, the consumer can: return the goods, cancel the entire contract without penalty, and receive a full refund" She does not want a refund, only wants to change phone for one that does support What's App.
