I bought shorts in July 2013 at Jam Hillcrest. The third time I used them (during my holiday) the whole backside cracked in a length of 20cm. The fabrique of these shorts is of inferior quality you would expect after 50 times washing but not after washing them twice! On Saturday the 28th of September I explained the responsible person at Jam Hillcrest what happened. She kept the shorts and promised to phone me back on the following Monday, which didn't happen. I phoned her on Monday and she explained to me, that she had asked at Head-office and their answer was that they would not consider to replace or refund the failed product. As a factory shop they would be not liable.

- in any transaction or agreement pertaining to supply of goods to consumers, it is an implied provision that the producer or importer, distributer and retailer each warrant that the goods comply with the requirements and standards of being safe, of good quality and durable.
-consumers are permitted to return goods to suppliers, without penalty and at suppliers risk and expense, within a period of 6 (six) months after delivery of such goods, if the goods are of inferior quality.
