Shocking customer service and faulty phone

I took delivery of a new blackberry bold in May 2013. The phone (only 4 months old) has developed a problem with its speaker and I cannot hear when a call is made or received. I called the customer care where I spoke to a guy by the name of Thato/Thabo who told me that as the phone is not yet 6 months old, I need to take the phone back to the branch where I can either ask for a refund, a replacement or repair, in accordance with Cell C subscriber agreement which states "7.4. In addition to any warranty on the Goods from the manufacturer, we warrant that any Goods supplied to you are not defective or faulty and you may return defective Goods within 6 months of delivery and you may choose to receive a refund, or replacement Goods or repairs to the Goods"
This morning I took the phone into the store where I was told that the phone has to be sent away for 21 working days to be repaired and that I can have a loan unit but the loan units are all blacklisted so cannot be used! This is crazy! I again called customer care and spoke to Nosipho who I told I have my own business and cannot afford to be without a phone! I even offered to upgrade again to get a different phone! This is shocking!
