What a disappointment!

I upgraded to a Blackberry 9360 in February 2013, the phone gave problems from the start, they send it in for repairs, I got it back after 3 weeks. Then the problems started again after about 2 months, I took it back and insisted on a new phone, the lady said she can't do anything, we must send it for repairs again. I allowed them to do this, but indicated on the booking/order that I want a new phone! Well, that didn't happen, 3 weeks later it was returned again and worked for another couple of weeks, and now the same problem arose again. Clearly this is a piece of, and I need a new cellphone. According to Chapter 2, Section 56, a consumer can return goods to a supplier within 6 months of their delivery, if the goods fail to satisfy the agreed standards and requirements (which state that the goods must be in good working order, free of defects etc - see Section 55 for details). This return must take place without penalty and at the supplier's risk and expense. The supplier must either repair or replace the failed, unsafe or defective goods, or refund the consumer. If there is a problem with the repaired good within the next 3 months, the supplier must replace it or refund.
