Shocking Service Level and Breach of Contract

I purchased a Sony Expira Z from MTN in Woodmead on June 13th, 2013 two days later I found that the speaker was faulty (I could not hear the person and the speaker was vibrating when ringing).
Took it back to the store on June 15th, 2013, the sales persons decided to send the phone for assessment instead of giving me a new phone as per contract conditions (breach of contract). I challenged this but he said that he is acting on his manager's (Linden) instructions.
I was told that I will be given feedback in three days; nobody phoned, I had to phone MTN 808 to find out what is happening but I could not be helped as I did not have the MEI number (didn't have the phone).
After almost two weeks I went to the store and they could not tell me what was going on; for this reason of shocking service I cancelled the contract. Went to the store the second time had to feel a second cancelation form.
The third time I was told the matter was handed to the regional Manager Jonathan Scarlet who tells me that MTN has no procedure in place to deal with this type of cancellation.
This lack of service and commitment is unacceptable; it is now a month with no solution.
