Refusal to replace product or cancel contract

I S Chetty purchased a Samsung Galaxy 4 contract with Cell C Gateway in Umhlanga. I picked up the phone from a consultant on 2 July 2013 . The Box was opened by the consultant and switched on. WITHIN A DAY THE PHONE STARTED FREEZING
I returned the phone on the 4th day 5 JULY 2013.. The consultant SAID that irrespective of whether I want a replacement or a cancellation I need to do a OBF and send the phone to Cell. He said that the cancellation or replacement will only be done if they find no damage on the phone from my side.
Cell C reported that there is nothing wrong with the phone. Now they are refusing to cancel or replace the phone. I know that the phone has a latent defect because it froze on me.
The phone is still WITH Cell C . I know that the phone is working but it freezes on me.
At Cell C Gateway I SPOKE TO Ashna Cassie and with Cell C Customer service I spoke to Jarod Govindsamy. Both are stalling. The process has taken 3 weeks with no solution.
ALL I WANT AS A CUSTOMER IS MY CONTRACT cancelled OR A NEW PHONE. I AM NOT PREPARED TO CONTINUOUSLY SEND MY BRAND NEW PHONE FOR REPAIRS.
