Faulty Samsung Galaxy S4 within 2 mnths of purchas

I took out a contract with Cell C, for a Samsung Galaxy S4, on the 21st of June 2013. In July the phone started overheating while in use. Towards the end of August the phone discharged and switched off within 10 minutes after being charged. On the 5th of September, the phone was returned to Cell C for a replacement. Our request was declined and I was informed that I can only get a refurbished phone. It is now 10 days that I have been without a phone.

I consider this to be incredibly unfair as the phone was still brand new. Hardly a month after the date of purchase the phone started showing signs of being faulty.

I only reported the matter after the cellphone fault worsened to a point where the phone would automatically switch off after 10 minutes of being fully charged.

Your intervention will be highly appreciated.
