New phone overheating, NOT REPAIRED OR REPLACED

I did an upgrade and got a new Samsung Mini S4 from Cell C Gateway. The phone overheated everytime the 3g was on. To the point that i could not hold the handset. I returned the phone to Cell C Gateway where i collected it, i let the consultant in store feel how hot the phone was and he agreed it was not normal. I filled in the documentation and they took the phone back. They told me the phone will be assessed and i will be contacted. I waited 7 days without a phone for them to tell me that their technicians sent the phone back and found no fault. This was not the response i was expecting after being made to wait for 7 working days. I asked the store manager what do i do if it overheats again, her reply was we will follow the same process as we did now. She told me it's not their fault, it is the Samsung Technecian's who said there is no fault, the problem i have is that i did not take a contract with Samsung, i took a contract with Cell C and not i have a bill at the end of the month for a phone i dont have and dont want. This is TOTALLY unacceptable!!!
