Still without a handset 2 months into the upgrade

My husband applied for an upgrade on the 6 May 2013 at the Centurion Mall branch Nashua Mobile and was informed that they were out of stock and had to wait for almost a month till he finally got it.
Once he got the handset he used it for 3 days and we noticed that it had a problem with the battery discharging whilst it was not in use and since we know that if there is a fault discovered within 7 days, the handset is replaced.
My husband dealt with one of the consultants at the branch and was told that the battery was an accessory and he needed to buy himself another phone/battery and after calling head office it was clarified that an OBF would be logged and once approved a replacement phone would be given.
Since then we havent received a phone and there is no feedback.
We finaly went to the branch on tuesday this week and we were told that they knew nothing about the phone and after several phone calls the consultant told us that we were supposed to wait another 21 days as the phone was getting repaired.
That is unacceptable, my husband has been given the same phone without any explanation if it even works, we are going to escalate this if no one sorts it out
