Misrepresented phone abilities

Went to la Lucia to ugrade my wifes phone she wanted to downgrade the phone and buy a tablet at the same time. She asked if the phone (a Samsung) could use whatsapp and was told that it could. On the strength of this she accepted the phone and signed the contract. When we got home we tried unsuccessfully to load whatsapp we took the phone back to la Lucia and they tried to load the programme again unsuccesful. They then said they woulsd send it back to who ever. It is obvious at this stage that they were still under the impression that it could load whatsapp. We picked up the phone today to be told that it cant load whatsapp and they cant help any further and we would have to accept this phone even though we offered to upgrade and spend more if neccessary.
It is interesting to note that the box has a sticker on it that says "DOA Rejected". Was this phone sent as a phone that was dead or was the full complaint actually fully communicated??
