MTN refuses to accept Samsung S3 for repairs

My daughter went to MTN (Pavilion - Durban) more than a month ago with a problem with her phone switching off. They told her the battery was faulty. MTN did not have stock at the time so she went to another supplier in the same business centre and bought a battery (about R400). The phone only worked until the battery was flat. Then the same problem reappeared. I took the phone in again. It was sent for repairs but on return the same problem re-appeared. As soon as the battery was flat, the phone could not be recharged. We have been back to MTN twice since but they refused to accept the phone for repairs or replacement without the charger (now lost). We offered to purchase a new charger but they still refuse, saying that there will be a serial number problem? Does this mean that if a charger is lost, you automatically lose your warranty on the phone? In the meantime my daughter has paid for a full month's contract, and another payment is due whilst she had not had the benefit of the use of the phone. So in effect, this phone will be costing us about R1200.00 shortly for no service. What now??? Should I report this to Samsung?
