As with another disappointed customer, I too had purchased goods from [URL Removed] which were marked at R9.95. Whilst waiting in anticipation to receive the purchased items, I instead receive correspondence from [URL Removed] stating that there was an error with the input of data. One may argue that a customer agreeing to purchase a product at a specified price is in fact an offer made by the customer and the retailer is not obliged to accept such offer. Although, once payment has been made and the retailer accepts payment, this is then a formalised contract and is grounds for both parties to uphold the contract.
I have already sought legal advice in this respect from a friend in the legal fraternity and he believes I should pursue this matter further as I have a strong case as a disclaimer or any such notices by [URL Removed] does not serve as a waiver against incorrect pricing. Furthermore he further advises, that such malpractices totally contravene the sheer point of the Consumer Protection Act. I have taken the decision to take this matter further and if need be approach the small claims court and let them decide on this matter.
