Goods return period constitutionally

We bought a hand set of which we return to the shop within 7 working days after realising that it had some defects but unfortunately we were not welcomed instead we were told that we should have come within seven days calculating from the date of purchase including Saturdays, Sundays and public holidays of which is not in line with the Constitution of the country, to make matters worse they are still in position of our handset, and we are paying the instalment for something we are not using while the store keeps if for their selfish ideas, we bought the said handset on the 19th of November 2012 and return it to the store on the Thursday the 27th of November 2012 to date thy are still in position of the same handset but the expectation is that we must pay for it
we have said to them because we are also protected by the same constitution that protects them we demand a new hanset
