Harcourts
Deposit Not Returned

I had a rental contract with Harcourts in Rustenburg.
It was for 24A Heystek Street and we paid a R7800 deposit upon signing our contract with Harcourts.

We gave notice, had an inspection done and moved out at the end of May 2013.
The agent confirmed that everything is in order with the inspection and that the deposit will be paid out.

I contacted her last week to find out when the deposit will be paid back to us.
She said that she is working on it and that I can send her banking details to confirm.
So I did send her banking details for the same account that the deposit was made from initially.

Today I phoned her again after the deposit still hasn't reflected.
She said that the deposit was already paid out to the owner and that he has to return it to us.
He has now found fault at the property and wants compensation for that. You, Harcourts have already signed off a successful inspection.

I have a problem with this.
By law, Harcourts has to put our deposit into a trust fund which wasn't done.
By law, the deposit has to be paid out to the occupant after a successful inspection and certain conditions which were all met.

We would like to have this deposit return
