The Build Shop not honouring quarantee

The Build Shop extended my patio during Apr-Aug2012. I received a 5 year guarantee on the structure. With the first summer rains in October the patio started leaking. Before the project started I asked him numerous times if there will be a leakage, and he kept on saying there wont. He was there about three times last summer, and again four times this summer. The problem seems to get worse and water is now coming through the light fitting! I got a quote for a waterproofer and I was willing to pay the waterproofer and the new tiles (as the tiles must be lifted.) I only requested him to remove the tiles and re-tile once the waterproofing is done.
According to him it is unneccassary and was unwilling to assist since he think he already came to the party to whatever he tried without succeeding.
I am now stuck with the problem and need to fix the leakage on my own expense.
