On 29 April 2013, I confimed an order for blinds and paid a deposit. We were expressly told that delivery would be within 3 to 4 weeks. After 4 weeks had expired I contacted Coolshade and was told that they were having supplier problems. Suffice to say that the fact that the client had to contact the supplier and not the other way around is very poor client service. In addition to this, it was only when pressure was brought to bear by ourselves that Coolshade committed to delivery on 4 June 2013.

Section (19)(5)(b) of the Consumer Protection Act. This requires, in the case of a special order agreement, that the blinds must reasonably confirm to the material specifications of the order. Coolshade have admitted, and I quote that, "These goods were, admittedly made incorrectly...".

In terms of Section 20 (2)(b) of the CPA, I as the consumer have a right to return the blinds to Coolshade and receive a full refund of any consideration paid for those blinds.

I am told that they cannot refund me as they spent the R8 000 purchasing the material.

Think twice before dealing with a company that is willing to fly in the face of the Consumer Protection Act.
