Response with regards to an accident claim

On the 14 of June on the way to work I was involved in a car accident. A young lady who was driving an Avis rental failed to stop at the stop street I unfortunately went into her side. After checking no one was injured we exchanged details etc. She had made a police report acknowledging that she was in the wrong and had skipped the stop street. Avis is now telling me to rather claim from my own insurance as I may still be liable for the accident because I didn't make enough effort to avoid hitting her. So now I'm sitting without transport for the last week, have a huge list of forms to fill out for them and there is still no guaranty that they will pay to have my car fixed. I shudder to think what they are putting the driver of the other car through. After reading other comments on Hellopeter I see I am not the only person to go through this injustice. F@%k you Avis!!!
