Accident caused by an AVIS rental vehicle

I refer to the accident that took place on the 14th May 2013, where foreigners where driving an AVIS rental car. Two vehicles were driving up a two way lane side by side to each other. The AVIS vehicle was on the right and our vehicle on the left. The drivers of the AVIS vehicle decided to turn left, they did not see our vehicle and knocked into our vehicle. This accident was completely caused by the foreigners driving the AVIS vehicle who did not see us on the left and when they jumped out continued to apologise profusely acknowledging that it was their fault. We have photo's off the incident. Avis wanted to settle 75/25 referring to SA case law trying to intimidate us and said our driver should have been more vigilant. I could contest this statement by asking you what would have been the difference if my vehicle was stationary? Should I then have been even more vigilant? Absolutely ridiculous!! They will now settle for 80/20. Why should we pay for the damages of their vehicle an accident caused by their driver. Each individual who hires a rental vehicle takes out either (CDW) Collision Damage Waiver or (SCDW) Super Collision Damage Waiver, which is how AVIS recover your cost.
