Not Bending over backwards as they claim

I am an OUTsurance member and to date I have no issue with them but the service received recently has been putrid. OUTsurance claims to bend over backwards for their client which is not the case.
Car accident occurred on 23/10/2012 third party knocked into my vehicle. I claimed from outsurance as I need to get my car fixed and was informed I need to pay the access and they will claim from the third party. Witness was also present at accident and I spoke to the witness personally the day after the accident and he confirmed that he will give his statement. Now 5 months later after I provided OUTsurance with all the details required to process this claim I am informed that I will not get my access back as they cannot get hold of the witness as the third party insurer claim the accident was my fault.

This is unacceptable as they could have informed me much earlier in the process of what was going to happen in the end. I was under the false pretense that all was in order as the police report was provided accurately and in time and now OUTsurance just informs me there is nothing they can do.
