3rd party claim declined for no reason

Magdaline Kgengoe was involved in an accident a few months back with a learner driver who was in the other car with her mother, the father came to the scene after the accident happened, he is a police officer and insisted want will make the statement which was incorrect, Magdaline then made an additional statement right below his on the police report, to state the actual happenings of the accident. We have a witness who has been contacted by outsurance and a statement that discribes the accident in detail and they declined the claim, with the reason that thier client had a duty to move the car and clear the intersection, therefore they had to decline the 3rd party claim. This is not a valid reason for the claim to be declined. Please assist
