Ecovery of claim not insurance companies problem

I've been with this insurance for more than 6 yrs and never claimed from them before. Last yr I had an accident which was not fault. I claimed and paid the access fee. I was told the insurance company will recover all fees from the 'defendant'. Up till today I didnt receive a single cent from anybody. When I inquired about this, I was told a letter was sent to the responsible person and there was no reply. It was left and written off as untraceable.!!! So I can do anything to anybody and just play dead and you take it at face value that you cant find me. I was told by Irvin that that is not recovery of fees is not really the insurance departments problem and they are doing me a favour sending out a letter to the other party.!!! I pay you a monthly premium you dont help me out the goodness of your heart. He suggested I go to the small claims court for recovery. Im taking my insurance to another company if this is treatment you get from 6 yrs of loyal payment. Irvin is a lazy, the last time i had to do his work for him when I had to trace the person who drove into me and get him to sign the release forms. I say fire him
