Vodacom
Cooling off period violation

Telecommunications

Yesterday, I went to the Rosebank Vodacom4u shop to purchase a samsung note 10.1 on a 24 month contract. The contract was for R400 a month and I signed the contract, took the device and the contract was activated. On the same day, I discovered that MTN provide the very same contract at R329 per month which resulted in me changing my mind on the Vodacom contract. When I returned the device (unopened and undamaged) to Vodacom4u shop, I was told that I could not change my mind on the agreement as the contract was active. Now under the consumer protection act purchases are subject to a 7 day cooling off period in my mind but I was told at the Vodacom shop that this does not apply to contracts that are agreed upon on their premises, only contracts that they issue online. To me this makes absolutely no sense as a company can not pick and choose when the law of the land applies to their operations.
