Problems with my Blackberry Curve

Hi
I am trying to figure this out. i have had my Blackberry for a year now, and since I have had it, if i am outside where its windy or even slightly warm, i cannot use my phone.
It keeps scrolling to the top while i try type or bb or even try dial a number.
I have on many occassions returned it to whom i bought it from and taken it to Vodacom to query, and all I get is the same answer " its a software problem on my kind of phone". Now how does that become my problem?
I go in and close all open apps, I have even deleted apps, but in an emergency and i am in the car, i can even get the cursor to stay where im typing or dialing, it keeps jumping to the top of the page.
I live in Cape Town and went to Jhb on holiday and thought maybe Vodacom there could assist, but got the same story, " Its a software problem on that make of phone". My question is why was it sold to me then???
