Insurance payout for damaged cellphone

I had a problem with my Samsung Galaxy II phone which I took in to Vodacare at Vodaworld. It would not switch on. They told me after a few days that the phone was not repairable and that I had to claim from Cell Sure. My phone was insured for R5000. I spoke to one of their consultants who told me that I could choose a phone from the Vodashop. Unfortunately the Samsung II was discontinued and I was not prepared to pay an additional R1550 for the Samsung III. I decided then to purchase a Huawei phone which had better features than the Samsung II and there it was on special. I bought the phone for R2000. I submitted my receipt and was paid out R1199!! I was absolutely furious. The consultant told me that i was charged an excess- no problem there- as well as a surcharge because the phone had liquid damage. Also I was paid out on the value of the phone that I bought and not according to the phone value that was damaged. IS THIS LEGAL?? Its like insuring your Mercedes Benz, it being but you get paid out for a VW because that is what you decided to buy afterwards. My claim reference was VDN 42957
