Replacement of phone with refurbished phone

My Z10 blackberry stopped working to a software failure (for no reason and through no fault of mine)

MTN have decided that the phone needs to be replaced but they are supplying me with a refurbished phone, how dare they do this? The phone was less than a year old - what problems am I know going to pick up with a "refurbished" phone, this is UNACCEPTABLE. I demand a new phone
