Any excuse not to fix your phone...!!!

I have a bb bold 9800 touchscreen on contract from MTN since may 2013, and have been advised by Mtn montague gardens that they will not fix my phone due to scratches (white phone which is easily scratched) and damage to the phone. My argument is that I am not asking for the cover or scratches to be fixed but the actual issues that FOUR people I know of complain about. Most ppl these days say bb is rubbish they will never purchase it again, even assistant in the cell shops agree that the product is inferior, this I found out AFTER i puchased the phone.

Within a month the battery went, which meant running around between appointments with a charger as it would not last more than a few hours. How can i be told my phones warranty is not valid and will not be fixed when the very same complaints I have are from people who also own the same make and model, maybe black with less visible scratched but every one complains аbout:
Poor battery life and call quality, the middle scroll button and touch screen which either is slow to respond. poor network... what does the cover have to do with the fact that s many ppl complain about the same issue with this phone? Easy way to not assist
